The ongoing cynicism about leaders and organizations calls for a new standard of ethical leadership that we have labeled “transformative leadership.” This new leadership model integrates ethically-based features of six other well-regarded leadership perspectives and combines key normative and instrumental elements of each of those six perspectives. Transformative leadership honors the governance obligations of leaders by demonstrating a commitment to the welfare of all stakeholders and by seeking to optimize long-term wealth creation. Citing the scholarly literature about leadership theory, we (...) identify key elements of the six leadership perspectives that make up transformative leadership, suggest leaders who exemplify each perspective, describe the ethical foundations and message of each perspective, and offer ten propositions that scholars and practitioners can use to test the dimensions of this new transformative leadership model. "Charles "Teenie" Harris photographed the events and daily life of African Americans for the Pittsburgh Courier, one of the nation's most influential Black newspapers. From the 1930s to 1970s, Harris created a richly detailed record of public personalities, historic events, and the lives of average people. In 2001, Carnegie Museum of Art purchased Harris's archive of nearly 80,000 photographic negatives, few of which are titled and dated; the archive is considered one of the most important documentations of 20th?century African American (...) life. The book will serve as the definitive publication on the life and work of Teenie Harris, consisting of three significant essays: Cheryl Finley, assistant professor in the history of art at Cornell University, offers the first thorough analysis of Harris as an artist, situating him within the history of 20th?century African American art as well as American documentary and vernacular photography; Larry Glasco, associate professor of history at the University of Pittsburgh, draws on new research to present a detailed biography of the photographer; and Joe Trotter, professor of history and social justice at Carnegie Mellon University, explores the social and historical context of Harris's photographs. Are individuals responsible for the consequences of actions taken by their community? What about their community's inaction or its attitudes? In this innovative book, Larry May departs from the traditional Western view that moral responsibility is limited to the consequences of overt individual action. Drawing on the insights of Arendt, Jaspers, and Sartre, he argues that even when individuals are not direct participants, they share responsibility for various harms perpetrated by their communities.

This is a paper about the methodology of normative ethics. I claim that much work in normative ethics can be interpreted as modelling, the form of inquiry familiar from science, involving idealised representations. I begin with the anti-theory debate in ethics, and note that the debate utilises the vocabulary of scientific theories without recognising the role models play in science. I characterise modelling, and show that work with these characteristics is common in ethics. This establishes the plausibility of my interpretation. (...) Taking methodological inspiration from modelling in science gives us new tools for managing idealisations, and a new perspective on pluralism. I demonstrate why this interpretation is a fruitful way of interpreting ethics, by looking at three case studies. First, I return to the anti-theory debate and argue that modelling opens up a new middle ground. Second, I argue that a modelling lens offers a new way of understanding impossibility theorems in population ethics, and their bearing on ethics as a whole. Finally, I show how viewing our work as modelling can be deployed in debates within ethics, using the debate over prioritarianism as an example. I close with further methodological suggestions for those who choose to see themselves as modellers. I discuss the role of counterexamples, our responses to moral disagreement, and the training of new ethicists. (shrink)

In this, the first major philosophical study of contingent pacifism, Larry May offers a new account of pacifism from within the Just War tradition. Written in a non-technical style, the book features real-life examples from contemporary wars and applies a variety of approaches ranging from traditional pacifism and human rights to international law and conscientious objection. In this volume, the third in his trilogy on the philosophical and legal aspects of war and conflict, Larry May locates a normative grounding for the crime of aggression - the only one of the three crimes charged at Nuremberg that is not currently being prosecuted - that is similar to that for crimes against humanity and war crimes. He considers cases from the Nuremberg trials, philosophical debates in the Just War tradition, and more recent debates about the International (...) Criminal Court, as well as the hard cases of humanitarian intervention and terrorist aggression. His thesis refutes the traditional understanding of aggression. At Nuremberg, crimes against humanity charges were only pursued if the defendant also engaged in the crime of aggression. May argues for a reversal of this position, contending that aggression charges should be pursued only if the defendant's acts involve serious human rights violations. (shrink)

The pace of change and, indeed, the sheer number of clinical ethics committees has accelerated during the COVID-19 pandemic. Committees were formed to support healthcare professionals and to operationalise, interpret and compensate for gaps in national and professional guidance. But as the role of clinical ethics support becomes more prominent and visible, it becomes ever more important to address gaps in the support structure and misconceptions as to role and remit. The recent case of Great Ormond Street Hospital for Children (...) NHS Foundation Trust v MX, FX and X, [21]–[23] and [58]) has highlighted the importance of patient/family representation at clinical ethics committee meetings. The court viewed these meetings as making decisions about such treatment. We argue that this misunderstands the role of ethics support, with treatment decisions remaining with the clinical team and those providing their consent. The considered review by clinical ethics committees of the moral issues surrounding complex treatment decisions is not a matter of determining a single ethical course of action. In this article, we consider current legal understandings of clinical ethics committees, explore current concepts of ethics support and suggest how they may evolve, considering the various mechanisms of the inclusion of patients and their representatives in ethics meetings which is not standard in the UK. What awakened Kant from his dogmatic slumber? On the traditional narrative, he was awakened by Hume's challenge to our cognition of causal connections. A more recent narrative claims that he was awakened by Hume's challenge to our cognition of non‐logical connections more generally. In this paper, I argue that a key part of Kant's awakening was far wider‐reaching: he came to realize that all dogmas must be abandoned. An oft‐overlooked technical notion, dogmas are non‐logical principles cognizable to unaided human reason. (...) I detail how Kant repudiated dogmas by the mid‐1760's in engaging with his German predecessor, Christian Crusius. This repudiation lays the foundation for his critical project. For once liberated of dogmas, reason must look beyond itself for the principles that would enable rational cognitionof non‐logical connections. (shrink)

What does it mean to be a morally responsible man? Psychology and the law have offered reasons to excuse men for acting aggressively. In these philosophically reflective essays, Larry May argues against standard accounts of traditional male behavior, discussing male anger, paternity, pornography, rape, sexual harassment, the exclusion of women, and what he terms the myth of uncontrollable male sexuality. While refuting the platitudes of the popular men's movement, his book challenges men to reassess and change behavior that has (...) had detrimental effects on the lives of women and of men. In May's view, the key to solving many problems is to understand how individual actions may combine to produce large-scale, harmful consequences. May is eager to reconceptualize male roles in ways that build on men's strength rather than rendering them androgynous. Each chapter in his book suggests strategies to effect changes based on May's views on the nature of moral responsibility. Examining separatism and the socialization of youth in athletics and the military, specifically at Virginia Military Institute and the Citadel, May analyzes the moral implications of the way all-male environments are constructed. In recent philosophy of science there has been much discussion of both pluralism, which embraces scientific terms with multiple meanings, and eliminativism, which rejects such terms. Some recent work focuses on the conditions that legitimize pluralism over eliminativism – the conditions under which such terms are acceptable. Often, this is understood as a matter of encouraging effective communication – the danger of these terms is thought to be equivocation, while the advantage is thought to be the fulfilment of ‘bridging roles’ (...) that facilitate communication between different scientists and specialisms. These theories are geared towards regulating communication between scientists qua scientists. However, this overlooks an important class of harmful equivocation that involves miscommunication between scientists and nonscientists, such as the public or policymakers. To make my case, I use the example of theory of mind, also known as ‘mindreading’ and ‘mentalizing’, and broadly defined as the capacity to attribute mental states to oneself and others. I begin by showing that ‘theory of mind’ has multiple meanings, before showing that this has resulted in harmful equivocations of a sort and in a way not accounted for by previous theories of pluralism and eliminativism. The highly publicized deaths of research participants Ellen Roche and Jesse Gelsinger are stark reminders that risk is inherent in medical research and while untoward outcomes are infrequent when compared to individual and societal benefits, injury and even death will happen. Who is responsible for the welfare of research subjects and what are they owed? Why were they put at risk to begin with? Are obligations, if any, to research subjects dependent on the type of study in which they participate, (...) in recognition that there may be personal benefit from participation in some studies?The issue of injury resulting from participation in research and answers to questions such as those just posed were last considered in depth nearly 20 years ago by the President's Commission for the Study of Ethical Problems in Medicine and Biomedical and Behavioral Research. Art world talk of “blurred boundaries” and “hybrids” between art and craft, suggests that the philosophy of art needs to rethink the concept of craft. This can best be done by adopting four strategies: first, distinguish between craft as a set of disciplines, and craft as a process and practice; second, keep in mind the differences among craft practices such as studio, trade, ethnic, amateur, and DIY; third, recognize that craft’s relationship with design is as important as its relationship to (...) art; fourth, attend to the role digital design and fabrication are playing in craft and art today. At the core of the craft process are three contested characteristics found in most craft practices: hand, material, and skill, although these are better understood as body, medium, and mastery. After discussing a fourth contested characteristic of many craft and design practices, function, I show that none of the four characteristics is a requisite condition for artistic practice today, yet none are excluded from contemporary art, despite its current “post‐studio” or “post‐disciplinary” tendencies. I conclude that the boundary between art and craft conceived as a set of disciplines defined by materials and techniques has not become blurred, it has all but disappeared. On the other hand, I show through an analysis of some references to “mere craft” by Stephen Davies and Arthur Danto, that craft conceived as a process and practice can be understood as distinct from art, but in a non‐invidious sense. The first part of this paper surveys types of olfactory art as well as some of the philosophical denials that odors and the sense of smell can be used for serious art making, raising the paradox that olfactory art seems actual, but the mainstream philosophical tradition has declared that one cannot make genuine artworks from odors. The second and third part of the paper address the primary argument against possibility of an olfactory aesthetics, namely, the claim that the human sense (...) of smell does not have sufficient cognitive capacity to support rational aesthetic discussion and judgment. The second part (The intuitive case for smell’s cognitive powers) examines and answers intuitive philosophical arguments against smell’s cognitive potential and the third part (The empirical case for the cognitive capacity of smell) first surveys evidence from the sciences that could be interpreted as supporting the negative position, before marshalling other empirical evidence in favor of smell’s cognitive powers. I conclude that on balance contemporary neuroscience and psychology support the view that the human sense of smell has the cognitive capacity to sustain rational aesthetic discussion and judgment. This chapter examines the dividing line between combatants and civilians during contemporary asymmetric conflicts against nonstate actors, the preeminent type of military conflict in this age of global terrorism. Although the dividing line between combatant and civilian is well explored in both the legal and philosophical literatures, this chapter examines the subject explicitly through the lens of necessity. In particular it conentrates on the difficulty of sorting out civilians from combatants when an individual may cross the line at will, and (...) may be involved in exercises such as serving as a human shield. The chapter concludes that the fundamental element of status, which is the foundation for status-based targeting and status-based detention, is starting to break down in contemporary asymmetric conflicts. In ‘Is Art Modern? Kristeller’s “Modern System of the Arts” Reconsidered’ (BJA, 49.1 (2009), pp. 1-24), James I. Porter sets out to discredit Kristeller’s ‘modern system of the arts’ on the curious assumption that if Kristeller is right, one is somehow prohibited from investigating the ancients’ understanding of aesthetics. Unfortunately, Porter's paper misrepresents Kristeller's central aim, misses the real shortcomings of Kristeller's essay, and often obscures substantive issues behind simplistic dichotomies. Because the unwary reader might be taken in by some (...) of Porter's exaggerations and omissions, I will identify a few of these before addressing the issue of continuity and discontinuity in the concept of art, particularly with respect to the ancient world. Unlike Tocqueville's other writing, Recollections, which was never intended for publication, contained the internally contrary, multiple viewpoints characteristic of carnivalesque discourse. Its greater spontaneity may allow'us more easily to see some of the ways in which writing can undermine the intentions of the writer. In following the Recollections' treatment of the February revolution, the writing soberly sets out to embody the story of a deadly struggle between the bourgeoisie and the people over the issue of property but steadily veers off (...) in the direction first of irony, then satire, and finally carnival. Tocqueville's rhetorical ending shows him trying to turn his unruly text back into a cautionary tale of the moralistically ironic type. But the text keeps getting out of hand and dissolves moralism in a bath of satire and burlesque. (shrink)

We recall the characterisation of positive definite polynomial functions over a real closed ring due to Dickmann, and give a new proof of this result, based upon ideas of Abraham Robinson. In addition we isolate the class of convexly ordered valuation rings for which this characterisation holds.

The idea of due process of law is recognised as the cornerstone of domestic legal systems, and in this book Larry May makes a powerful case for its extension to international law. Focussing on the procedural rights deriving from Magna Carta, such as the rights of habeas corpus and nonrefoulement, he examines the legal rights of detainees, whether at Guantanamo or in refugee camps. He offers a conceptual and normative account of due process within a general system of global (...) justice, and argues that due process should be recognised as jus cogens, as universally binding in international law. When regimented in a certain natural way, the concepts of explanation and justification manifest a pattern of interrelations connected more or less systematically to their object. Besides its intrinsic interest, this pattern may give us some insight into the nature, source, and limits of the concept of argument.

This paper draws attention to two problems with Kant's claim that transcendental freedom is timeless. The problems are that this causes conceptual difficulties and fails to vindicate important parts of our moral practices. I then put forward three ways in which we can respond to these charges on Kant's behalf. The first is to defend Kant's claim that transcendental freedom occurs outside of time. The second is to reject this claim, but try to maintain transcendental idealism. And the third is (...) to reject both Kant's claim about the timelessness of freedom and also transcendental idealism itself. (shrink)

In November 2003, the University of Fribourg hosted a symposium on the ontology of colors. The invited participants included Justin Broackes, Alex Byrne, David Chalmers, Larry Hardin, Joe Levine and Barry Maund. The points of view presented by the participants in their thought-provoking papers were highly divergent. The presentation of each paper was followed by a long and intense discussion. Despite the divergence of the views proposed, the discussion during the symposium was highly focused. Several specific issues came up (...) repeatedly in the debate and illuminated the puzzle about the nature of colors in a thought provoking way from different angles. We include these papers in our brief description in the present introduction to present to the reader all the different viewpoints that have nourished the debate throughout the symposium. We are glad to be able to include one further invited paper by Jonathan Cohen in the present volume. In an attempt to transfer some of the atmosphere of the meeting to the reader and in order to make this collection still more stimulating we invited each participant to contribute comments on the other papers. Philosophy journals and conferences have recently seen several attempts to argue that ‘all-things-considered better than’ does not obey strict transitivity. This paper focuses on Larry Temkin’s argument in “Intransitivity and the Mere Addition Paradox.” Although his argument is not aimed just at utilitarians or even consequentialists in general, it is of particular significance to consequentialists. If ‘all-things-considered better than’ does not obey transitivity, there may be choice situations in which there is no optimal choice, which would seem to open (...) the door to a consequentialist account of moral dilemmas. Temkin’s argument crucially appeals to what he calls “the Person-Affecting Principle (PAP)”. which he roughly characterizes as follows, “On PAP, one outcome is worse than another only if it affects people for the worse” This paper argues that PAP, although plausible, does not hold in precisely those situations in which it would have to hold in order for Temkin’s argument against transitivity to work. Bermúdez argues for rational framing effects in the form of quasi-cyclical preferences. This is supposed to refute the extensionality principle in standard decision theory. In response, I argue that it is better to analyze seemingly quasi-cyclical preferences as ceteris paribus preferences. Furthermore, if frames are included as objects of choice, we can acknowledge rational framing effects without rejecting extensionality.

The philosophy of the Presocratics still governs scholarly discussion today. This important volume grapples with a host of philosophical issues and philological and historical problems inherent in interpreting Presocratic philosophers.

The neurosciences challenge the ‘standard social science’ model of human behaviour particularly with reference to violence. Although explanations of violence are interdisciplinary it remains controversial to work across the division between the social and biological sciences. Neuroscience can be subject to familiar sociological critiques of scientism and reductionism but this paper considers whether this view should be reassessed. Concepts of brain plasticity and epigenetics could prompt reconsideration of the dichotomy of the social and natural while raising questions about the intersections (...) of materiality, embodiment and social action. Although violence is intimately bound up with the body, sociologies of both violence and the body remain on the surface and rarely go under the skin or skulls of violent actors. This article argues for a non-reductionist realist explanation of violent behaviour that is also interdisciplinary and offers the potential to generate nuanced understandings of violent processes. It concludes that sociology should engage critically and creatively with the neuroscience of violence. (shrink)

Justifying ethical practices is no easy task. This paper considers moral justifications for peer review so as to persuade even the sceptical individualist. Two avenues provide a foundation for that justification: self-interest and social contract theory. A wider notion of “interest” permits the self-interest approach to justify not only submitting one’s own work to peer review but also removing oneself momentarily from the production of primary knowledge to serve as a rigorous, independent, and honest referee. The contract approach offers a (...) non-selfish alternative and relies on four types of binding social contracts: those implicit in accepting funds, those implicit in asserted professional status, those to contribute what is of most value to society, and those to defend the ideals of the Academy. Efforts to restore respect for rigorous, independent, honest peer review should begin in earnest. (shrink)
